The Hazardous Waste Bureau (HWB) is responsible for implementation of New Mexico's hazardous waste program, through authorization from the U.S. Environmental Protection Agency for the Resource Conservation and Recovery Act Subtitle C (hazardous waste) program. 

The HWB consists of three programs:

Compliance & Technical Assistance Program

The Compliance & Technical Assistance Program is responsible for conducting inspections and technical assistance site visits of all facilities that generate or may generate hazardous waste, including treatment, storage, or disposal facilities throughout New Mexico, exclusive of Indian lands. Data collected during the field activities are analyzed by program staff to determine whether violations of the hazardous waste regulations have occurred. The number and degree of violations determine the level of enforcement action. The program is responsible for inspection and site visits of facilities that generate or may generate hazardous waste; review of records and reports pertinent to those facilities; maintaining proper documentation of field activities and proper labeling, handling, storage, chain of custody and shipping requirements of samples; writing of reports summarizing the field activities; maintaining and calibrating field equipment; complying with approved standard operating procedures and quality assurance requirements; and responding to complaints and requests for information from the public.

Permits Management Program

The Permits Management Program is responsible for the management and implementation of RCRA (Subtitle C) permits and corrective action at treatment, storage and disposal facilities (TSDFs), Permitted Hazardous Waste Facilities, throughout the State of New Mexico, exclusive of Indian lands.

The program reviews permit applications, modifications, closure plans and post-closure care applications for hazardous waste treatment, storage and/or disposal for compliance with the hazardous waste regulations and with generally technical standards, and for the preparation of draft and final permits.  The program also handles corrective action work plans and reports, such as RCRA facility investigations, accelerated corrective actions, interim measures, and corrective measure studies.  These documents are reviewed, and comments are provided to the permitted facilities for cleanup and remedy activities of solid waste management units and areas of concern.  Staff are available for consultation regarding regulatory requirements, policy and guidance by the regulated community and other interested parties.

The program conducts soil, ground water, and surface water sampling events at TSDFs, provides response to citizen inquiries, and coordinates with other NMED programs and the U.S. EPA on permitting, corrective action and remediation issues.  In addition to these activities the program also implements and provides regulatory oversight of the Federal Facility Compliance Orders (FFCO) for mixed waste issues at Los Alamos National Laboratory and Sandia National Laboratories under the Federal Facilities Compliance Act (FFCA).
