- PLEADING LOG -

A Matter before the Water Quality Control Commission
in Public Hearing, Docket No. WQCC 08-13 (R)

Pleading Log

Public Comments

The New Mexico Environment Department (NMED) petitioned the Water Quality Control Commission (WQCC) at its December 16, 2008 meeting to conduct the triennial review of New Mexico’s Water Quality Standards, 20.6.4 NMAC. A review of the Standards on a three-year basis is required by section 303(c) of the federal Clean Water Act (CWA). Along with the petition, NMED presented its proposed amendments and narrative explanation.  In refining its proposed amendments, NMED considered the public input received on the August 11, 2008 Discussion Draft. See the Comment Summary for a synopsis of the comments received.

The Boards & Commissions Administrator docketed the matter as WQCC 08-13 (R) and prepared a pleading log, which was maintained throughout the course of the proceeding.  NMED filed a notice of revised proposed amendments on July 6, 2009.  The deadline for all parties to file notices of intent to present technical testimony was Friday, August 28, 2009. The hearing began on December 8 and ended on December 11, 2009.   The WQCC conducted its deliberations on this matter in 2010.

The pleadings (below) filed in this matter before the Hearing Officer on behalf of the WQCC include 134 entries from both public and private entities as well as the Hearing Officer and the Commission Chair.  Fifty-five public comments were received from individuals and both public and private organizations.  The Hearing Officer issued a report with an attachment, the revised NMAC 20.6.4 with editing marks revealed on Thursday, May 27, 2010 for Public inspection.  The WQCC's Order and Statement of Reasons for Amendment of Standards was issued on Thursday, October 14, 2010.

Contact information for the Hearing Officer appointed in this matter can be found at the bottom of this page.  For more information about the State's Triennial Review Process, please contact Kris Pintado, NMED's Surface Water Standards Coordinator, directly at (505) 827-2822.
