NOTICE OF TRANSCRIPT FILING

The Public is hereby notified that the transcript of the December 8-11, 2009 hearing in the Triennial Review of Standards for Interstate and Intrastate Surface Waters, 20.6.4 NMAC, has been filed. Certain post-hearing deadlines are triggered, pursuant to the Scheduling Order filed April 15, 2009, by the filing of this Notice. The transcript is available for review or duplication at the Water Quality Control Commission Office, New Mexico State Environment Department, Runnels Building Rm. N2150, 1190 S. St. Francis Drive, Santa Fe, New Mexico 87505. A copy can also be obtained from Kathy Townsend Court Reporters, 110 Twelfth Street, NW Albuquerque, New Mexico 87102, or (505) 243-5018.

The New Mexico Environment Department (NMED) petitioned the Water Quality Control Commission (WQCC) at its December 16, 2008 meeting to conduct the triennial review of New Mexico’s Water Quality Standards, 20.6.4 NMAC. A review of the Standards on a three-year basis is required by section 303(c) of the federal Clean Water Act (CWA). Along with the petition, NMED presented its proposed amendments and narrative explanation.

The Boards & Commissions Administrator docketed the matter as WQCC 08-13 (R) and prepared a pleading log, which was maintained throughout the course of the proceeding.  The Hearing Officer finalized the Scheduling Order and Hearing Guidelines.  NMED filed its revised petition on July 6, 2009.  The general public presented non-technical testimony at the hearing. The hearing began on December 8 and ended on December 11, 2009.   The WQCC conducted its deliberations on this matter in 2010.

The pleading log filed includes some entry items with multiple exhibits - such as this one.  Entry Item 50, Chevron Mining, Inc.'s Notice of Intent to Present Technical Testimony and its associated exhibits for the technical testimony of Steven P. Canton, Senior Aquatic Ecologist of GEI Consultants, Inc., are listed below are available here for presentation, reviewing, and downloading purposes.
