Water Quality Standards

New Mexico's WQS define water quality goals by designating uses for waterbodies, setting criteria to protect those uses, and establishing provisions to preserve water quality.

NMED petitioned the Water Quality Control Commission (WQCC) at its December 16, 2008 meeting to conduct the triennial review of New Mexico’s Water Quality Standards, 20.6.4 NMAC. A review of the Standards on a three-year basis is required by section 303(c) of the federal Clean Water Act (CWA). Along with the petition, NMED presented its proposed amendments and narrative explanation.  In refining its proposed amendments, NMED considered the public input received on the August 11, 2008 Discussion Draft. See the Comment Summary for a synopsis of the comments received.

The Boards & Commissions Administrator docketed the matter as WQCC 08-13 (R) and prepared a pleading log, which she will maintain throughout the course of the proceeding.  The Hearing Officer has finalized the Scheduling Order and Hearing Guidelines.  NMED filed its revised proposed amendments on July 6, 2009.  The deadline for all parties to file notices of intent to present technical testimony was Friday, August 28, 2009. The hearing is scheduled to begin December 8, 2009.   The general public may present non-technical testimony at the hearing. Please refer to the Scheduling Order for other important deadlines.

The pleadings filed in this matter before the Hearing Officer on behalf of the WQCC include 65 entries from both public and private entities.

New Mexico’s Water Quality Standards define water quality goals by designating uses for rivers, streams, lakes and other surface waters, setting criteria to protect those uses, and establishing antidegradation provisions to preserve water quality. The Standards are adopted by the Water Quality Control Commission, then approved by the United States Environmental Protection Agency (US EPA) under the federal Clean Water Act.

NOTE:  New Mexico’s Standards do not apply to waters on Native American lands. Tribes and pueblos develop and implement their own water quality standards. As with states, tribal standards are approved by the US EPA. Approximately half of New Mexico’s tribes and pueblos have US EPA-approved standards.
