MACT Parts 1 and 2 Application Information

 General Information

Owners and operators of major sources of Hazardous Air Pollutants (HAPs) in New Mexico need to know about the U.S. Environmental Protection Agency’s (EPA) promulgation of final amendments to Section 112(j) of the Clean Air Act and how EPA’s action may affect them.  This section of the Clean Air Act is commonly referred to as the “MACT Hammer.”  Section 112 of the Clean Air Act covers hazardous air pollutants, or HAPs.  Major sources of HAPs– those that emit 10 tons per year or more of a single HAP or 25 tons per year or more of combined HAPs – are controlled through the use of Maximum Achievable Control Technology (MACT).  EPA has been setting MACT standards for a variety of different source categories during the past 10 years, as required by the Clean Air Act Amendments of 1990. 

Recent amendments to Section 112(j) affect 33 source categories and make compliance with the Section’s requirements more flexible.  The amendments create a two-part application process to prepare for the MACT standards that EPA is now developing for the 33 source categories.  Many of your sources may already have Title V permits issued by the Air Quality Bureau; if this is the case, the MACT application procedure can be viewed as an addition to your Title V permit(s).  Many of your sources are covered by MACT standards that have already been promulgated by EPA; if this is the case, you do not need to complete a New Mexico MACT Application under the MACT Hammer revisions.

MACT Parts 1 and 2 Applications

Part 1 MACT Applications were due to the New Mexico Air Quality Bureau by May 15, 2002.  The Part 2 Application, which each major HAP source will be required to submit to the Air Quality Bureau by May 15, 2004, is currently under development and will be available at this website at a later date.
