Environmental Improvement Board

Note:  Amendments to 20.1.1 NMAC adopted last fall by the Environmental Improvement Board become effective today.  These amendments make several changes to the Board’s Rulemaking Procedures, most notably the following:

1. A petition for rulemaking is now due 20 days before the meeting at which it will be considered, not 15. The Administrator must prepare the agenda and distribute the Board packets 15 days before a meeting, not 10.
2. Notices of intent to present technical testimony must include the full testimony in narrative form and attach, not merely list, all exhibits.
3. Non-technical public comment may be mailed or delivered during the hearing; e-mail comment will not be accepted.  The Board webpage will have a public comment box in which comment can be submitted electronically.
4. A section on motions has been added, identical to the section on motions found in the Board’s adjudicatory rules.
5. Persons offering exhibits need not bring 20 copies as before, but 9 for the Board, Board counsel and hearing officer, in addition to one for each other party.
6. Motions for stay must be filed at least 30 days before the meeting at which the motion will be heard.

GREENHOUSE GAS EMISSIONS HEARINGS UPDATE

EIB 11-15/11-17:  The Board deliberated on February 6, 2012 and voted unanimously to repeal Parts 350, 300 and 301.  The Statements of reasons approved by the Board on March 6, 2012 are here and here.

EIB 11-16:  The Board deliberated on March 16, 2012 and voted unanimously to repeal Part 100. The transcript of deliberations is here.  The Statement of reasons will be addressed by the Board on May 7, 2012.
