The Federal Clean Water Act (33 U.S.C 1251 et seq.) requires in Section 301 that “except as in compliance with this section and sections 302, 306, 318, 402, and 404 of this Act, the discharge of any pollutant by any person shall be unlawful.” Section 402 of the Act establishes the National Pollutant Discharge Elimination System (NPDES) permit program. Section 404 of the Act establishes the Dredge or Fill Permit Program. The NPDES permit program is administered by the United States Environmental Protection Agency (USEPA). The Dredge or Fill Permit Program is administered by the United States Army Corps of Engineers (USACOE). Section 401 of the Clean Water Act requires “state certification” of permits issued by a federal agency under the Act. Section 401 further requires the State to have procedures to certify the federally issued permits. The purpose of such certification is to reasonably ensure that the permitted activities will be conducted in a manner that will comply with applicable water quality standards, including the antidegradation policy, and the statewide water quality management plan. The New Mexico Water Quality Act (Chapter 74, Article 6 NMSA 1978) assigns the responsibility of State certification to the Environment Department (§74-6-4.F).
