How is the Fund financed?
Money for the fund is generated by a per load
fee collected at the loading dock from wholesale
distributors of petroleum products. The fee is
$150 per load of 8,000 gallons.
Who is eligible for the Fund?
Owners and operators of petroleum storage tanks
who meet the following requirements:

There has been a release of petroleum from
a storage tank reported to and confirmed by
the regulatory agency.

As a result of this release, the owner or
operator must be required by a regulatory
agency to take corrective action.

For all expenses except the minimum site
assessment, the owner or operator must be in
substantial compliance with the PSTB
regulations.

The owner is not a federal facility.
-
The facility is not on Indian lands.
What does the Fund pay for?
The fund pays for corrective action costs
resulting from the unauthorized release of
petroleum from a storage tank which causes
contamination of soil and/or groundwater.
Corrective action costs include initial
abatement, minimum site assessment, soil and
water investigation, remediation, and
verification monitoring after the cleanup is
completed.
How does the Fund work?

Qualified owners and operators of storage
tanks are reimbursed for corrective action.

The department takes the lead at high
priority sites where owners and operators
are unknown, unwilling or unable to take
corrective action.
What types of claims does the Fund cover?
Reimbursement claims for costs paid or incurred
for investigation and cleanup work. Funds are
disbursed only after costs are actually incurred
or paid.
How much is the deductible?
In general it is the cost of the Minimum Site
Assessment or $10,000, whichever is less. But
there is a sliding scale:

If an owner has only one facility, which
has four or fewer tanks and a monthly
average throughput of not more than 20,000
gallons during the last two years of
operation before applying for reimbursement,
then there is no deductible.

If an owner has two or fewer facilities
with four or fewer tanks at each one and a
monthly average throughput of no more than
40,000 gallons during the last two years of
operation before applying for reimbursement,
the deductible is $5,000.
All of the costs of corrective action beyond the
Minimum Site Assessment are potentially eligible
for reimbursement, including the secondary
investigation, preparation of a remediation
plan, monitoring, operation and maintenance of a
remediation system.
