Qualifications
of Persons Performing
Corrective Action - 20.5.16 NMAC |
|
Pursuant to
20.5.16
NMAC effective August 15, 2003, all
persons performing corrective action on
behalf of storage tank owner, operators or
the state must be qualified by the
Petroleum Storage Tank Bureau to be
eligible for reimbursement from the
Corrective Action Fund. In addition, the
authorized representative MUST SIGN all
work plans, reports and claims. |

According to
20.5.16.1609 NMAC: Qualification of
Firms
|
"...firms
shall be evaluated for
qualification by the
department to conduct
corrective action for each
workplan submitted."
Qualification shall
include:

|
Subject workplan
|
|
Current statement of
qualifications of the firms' authorized
representative
|
|
The individual with
direct, responsible, supervisory
control of the approved workplan
|
|
|
Current statement of
qualifications of the professional engineer
(if required)
|
|
|
|
|
|
According to
20.5.16.1609.D NMAC: Statement of
Qualifications shall include:
-
Authorized
representative's name and status as sole
proprietor, officer, partner, employee or
subcontractor of the firm
-
Education relevant to the
nature of the work to be performed
-
Experience relevant to the
nature of the work to be performed
-
Licenses and certification
required for the work to be performed (if
required)

According to
20.5.16.1609.E NMAC: Minimum Requirements for
education and experience:

to 20.5.16.1609.F NMAC:

Firms
must maintain their qualifications
at all stages of work in order for
the costs of that work to be
eligible for payment
|
|
|
|
This would
include informing the department
of any change in the authorized
representative qualified for the
work approved.
